The Information Commissioner’s Office has launched an investigation into claims that a Just Eat delivery driver used a female customer’s personal data to send unwanted messages, including asking her if she had a boyfriend.
When contacted by the customer, Just Eat offered her a £10 goodwill voucher; a move which it has now admitted was “appalling”.
Michelle Midwinter posted screenshots of the WhatsApp conversation on Twitter in which the man calls himself “a fan” and adds “if you have a bf tell me”. He signs off “goodnight bby see you next time when I get your meal” with an emoji of a pair of lips. Midwinter responds: “I’m literally never ordering from there again.”
Midwinter wrote: “Just a snippet of Just Eat’s response to my receiving unsolicited messages from the guy who had just delivered my food. Nice one Just Eat! Apart from him using my number in this way surely being in breach of privacy laws etc, they don’t really seem to take it seriously do they??”
When Midwinter complained to Just Eat, a contact centre agent called “Trixie” responded: “In all honesty we don’t have a complaint department” but offered her a £5 goodwill voucher which was later upped to £10, adding “we don’t usually do this”.
Midwinter later said on Twitter she had been “astounded” by the number of women who had contacted her saying they had had similar experiences with other companies.
In a statement, the ICO said: “If a customer’s phone number is used for reasons for which it was not originally taken, it could be a breach of the Data Protection Act.
“Organisations have a legal duty to make sure personal data is only used for the purposes for which it was obtained. We are aware of reports of an incident involving Just Eat and will be looking into it.”
